SB13-284 Summary

• Requires the Division of Administration in the Department of Public Health and Environment to provide expedited air quality permit review for oil and gas operators that certify they will use emissions control technology meeting enhanced environmental and human health protection standards.

• Enhanced standards and expedited review procedures may be developed through division guidance, incorporation into existing rule-making proceedings, or separate rules adopted by the Air Quality Control Commission in consultation with the Colorado Oil and Gas Conservation Commission.

• Excludes from expedited review any facilities subject to federal Prevention of Significant Deterioration permitting, federal Nonattainment New Source Review permitting, or synthetic minor sources emitting or potentially emitting at or above 80 percent of the federal Title V major source threshold.

• Authorizes the Division to consider an oil and gas operator's Colorado compliance history and present compliance status when determining expedited review eligibility.

• Appropriates $222,291 and 2.9 FTE from the stationary sources control fund to the air pollution control division for implementation, allocated as $205,897 for personal services and $16,394 for operating expenses, effective fiscal year 2013.
