SB13-288 Summary

• Modifies the process for state claims board recommendations to the General Assembly regarding additional payments to claimants that exceed Colorado Governmental Immunity Act liability limits.

• Allows the Office of the State Controller to pay additional payments for Lower North Fork Wildfire claims (March 2012) received while the General Assembly is adjourned sine die, using previously appropriated moneys, upon Department of Law certification of compliance.

• For claims arising after the effective date (not related to the wildfire), requires all Joint Budget Committee members to vote to authorize additional payments while the General Assembly is adjourned sine die, with final ratification by bill required before payment.

• Specifies that additional payments must exclude noneconomic loss, be reduced by coverage from other sources, and be paid from the general fund with no insurer right of subrogation.

• Applies to additional payments made on or after January 1, 2013.
