Makes it unlawful for a person to obtain a booking photograph knowing it will be placed on a website or publication that charges a fee for removal.

Requires anyone requesting a booking photograph from an official custodian to sign a statement affirming the photograph will not be used on fee-based removal websites.

Defines "booking photograph" as a photograph or image of a person taken by a criminal justice agency at arrest or detention and prior to conviction.

Violations and false statements constitute an unclassified misdemeanor punishable by a fine of up to $1,000.

Takes effect September 1, 2014, subject to voter approval if a referendum petition is filed within 90 days after final adjournment of the general assembly.
