HB 14-1049: Offenses Against Unborn Children

• Adds Section 18-1-506 to Colorado law to allow prosecutors to bring homicide and assault charges simultaneously with underlying criminal charges when a crime causes death or injury to an unborn member of the species homo sapiens.

• Applies to any crime codified in Colorado's criminal code (Title 18) or traffic code (Title 42) where the crime is the proximate cause of death or injury to an unborn child.

• Requires potential five-year appropriation to cover any increased capital construction and operational costs in state correctional facilities resulting from increased imprisonment periods.

• Takes effect July 1, 2014, and applies to offenses committed on or after that date.

• Includes safety clause declaring the act necessary for immediate preservation of public peace, health, and safety.
