Increases the statutory cap on the two-year average of unobligated funds in the Oil and Gas Conservation and Environmental Response Fund from four million dollars to six million dollars.

Changes the effective date of the cap requirement from July 1, 2007 to July 1, 2014.

Maintains the requirement that the commission ensure adequate balance in the environmental response account to address environmental response needs.

Includes a safety clause declaring the act necessary for immediate preservation of public peace, health, and safety.
