HB 14-1104 Summary

• Creates a new Class 5 felony offense for posting or publishing intimate photographs of a person under 18 years of age showing uncovered genitals, buttocks, anus, or female breasts

• Requires that the photograph be obtained during a relationship or sexual encounter with the victim and that the person intended to embarrass, coerce, bully, annoy, harm, or cause emotional distress to the victim

• Imposes a mandatory minimum fine of $10,000 upon conviction, in addition to any other sentence imposed by the court

• Requires the court to order the defendant or the entity hosting the photos to remove all intimate photographs of the victim from the internet upon conviction

• Takes effect July 1, 2014, and applies to offenses committed on or after that date
