HB 14-1158 Summary

• Courts must sentence defendants convicted of class 3 felony vehicular homicide (under the influence) to at least the minimum term in the presumptive range for a class 3 felony, effective for offenses committed on or after July 1, 2014.

• Courts must sentence defendants convicted of class 4 felony vehicular assault (under the influence) to at least the minimum term in the presumptive range for a class 4 felony, effective for offenses committed on or after July 1, 2014.

• Defendants convicted of these offenses are not eligible for probation or suspended sentences.

• The bill does not prevent courts from imposing sentences greater than the minimum when required by other applicable laws.

• The act may require a five-year appropriation to cover increased capital construction and operational costs for state correctional facilities.
