HB 14-1167: English Language Proficiency Programs in Public Schools

• Repeals and reenacts the English Language Proficiency Act (ELPA), changing terminology from "students with limited English proficiency" to "English language learners" (ELL) and extending funding eligibility from 2 to 5 budget years per student.

• Requires local education providers to offer evidence-based English language proficiency programs that include identification and assessment of ELLs, English-language and content assessments, and processes for program exit and re-entry based on demonstrated proficiency.

• Establishes the English Language Proficiency Act Excellence Award Program to recognize local education providers that achieve the highest English language and academic growth among ELLs, funded through the Excellence Awards Fund.

• Creates the Professional Development and Student Support Program to provide funding to local education providers for compliance costs, professional development for educators working with ELLs, and expanded content proficiency programs, with funds distributed based on the statewide percentage of ELL enrollment.

• Requires the Department of Education to monitor local education providers' implementation through comprehensive oversight without requiring duplicate reporting of data already collected under state or federal requirements.
