HB 14-1180 Summary

• Extends the sunset date for regulation of outfitters by the Division of Professions and Occupations from July 1, 2014 to September 1, 2025.

• Expands the definition of "outfitter" to include entities (not just individuals) and clarifies that persons renting motor vehicles, livestock, or equipment are not required to register as outfitters.

• Updates guide qualifications to require guides to be at least 18 years old and hold first aid or first aid instructor certification from the American Red Cross.

• Adds disciplinary grounds including failure to respond to complaints, uncontrolled use of alcohol or controlled substances that impairs outfitting services, and makes persons ineligible to reapply for 2 years after registration revocation.

• Implements recommendations from the Department of Regulatory Agencies sunset review by clarifying language, adding administrative procedures including letters of admonition and confidential letters of concern, and allowing the director to appoint administrative law judges for hearings.
