Records custodians may impose fees for research and retrieval of public records only if they have posted a written policy on their website or otherwise published the policy prior to receiving the request.

The first hour of research and retrieval time is free; custodians may charge a maximum of $30 per hour for time exceeding one hour.

The Director of Research of the Legislative Council shall adjust the maximum hourly fee on July 1, 2019, and every five years thereafter based on the percentage change in the Denver-Boulder-Greeley Consumer Price Index.

Adjusted maximum hourly fees must be posted on the General Assembly website.

The act takes effect July 1, 2014.
