CO HB1226

Repeals Colorado Revised Statutes 25-17-104, which currently prohibits local governments from regulating plastic materials and packaging in consumer products.

Eliminates the state preemption that prevents local governments from requiring or prohibiting the use of specific types of plastic materials or products.

Removes restrictions on local government authority to mandate or restrict containers, packaging, or labeling for consumer products.

Takes effect at 12:01 a.m. on August 6, 2014, or 90 days after final adjournment of the general assembly, whichever is later.

Act is subject to voter approval if a referendum petition is filed within 90 days after adjournment; if challenged, requires approval at the November 2014 general election to take effect.
