House Bill 14-1294: Student Data Protection, Accessibility, Transparency, and Accountability Act of 2014

• Creates comprehensive student data privacy protections requiring the Colorado Department of Education to publish a public data inventory, dictionary, and index of student data elements currently collected and used in the state system.

• Establishes strict limitations on student data collection, prohibiting collection of juvenile delinquency records, criminal records, medical/health records, social security numbers, and biometric information unless required by state or federal law.

• Requires the Department of Education to develop a detailed data security plan including access authorization guidelines, privacy compliance standards, security audits, breach planning procedures, data retention policies, and staff training protocols.

• Restricts sharing of personally identifiable student data outside Colorado except for specific circumstances including student transfers, higher education enrollment, migrant student federal reporting, federal program compliance, and judicial orders or safety emergencies.

• Prohibits the Department from selling, trading, gifting, or monetizing student data for commercial purposes and requires vendors holding student data to have contracts with express privacy and security safeguards including penalties for noncompliance.
