SB14-029 Summary: Architectural Paint Stewardship Program

• Establishes a producer-financed paint stewardship program requiring architectural paint manufacturers to implement statewide collection and recycling systems for postconsumer paint effective July 1, 2015.

• Requires producers to submit program plans to the Department of Public Health and Environment by January 1, 2015, with plans including collection sites, reuse/recycling methods, education programs, and funding mechanisms through a paint stewardship assessment added to purchase prices.

• Mandates collection site coverage of at least 90 percent of Colorado residents within a 15-mile radius, plus additional sites for urbanized areas and annual collection events for remote populations.

• Prohibits charging customers for paint collection and requires programs to follow a waste hierarchy prioritizing source reduction, reuse, recycling, energy recovery, and disposal.

• Establishes enforcement penalties of $1,000 per day for first violations and $5,000 per day for subsequent violations, with appropriations of $84,045 and 0.9 FTE for program implementation.
