SB14-034: Strengthen Press Shield Law

• Raises the evidentiary standard for subpoenaing newspersons from preponderance of the evidence to clear and convincing evidence
• Requires parties seeking to subpoena newspersons to establish four elements: information was not obtained in confidence, information is highly material and relevant, information is critical to a material issue, and information is not obtainable from alternative sources
• Takes effect August 6, 2014, or upon voter approval if a referendum petition is filed within 90 days of final adjournment
• Applies to subpoenas issued on or after the effective date of the act
