SB14-079 Summary

• Any individual, including official ballot watchers, may challenge a mail or mail-in ballot based on elector eligibility to vote on specific ballot issues/questions/races or the signature on the ballot return envelope.

• When a ballot is challenged, the election judge must forward it to two other election judges from different political parties who review either the elector's eligibility or signature validity.

• If both reviewing judges determine an elector is ineligible to vote on specific ballot items, only eligible items are counted; if ineligible for all items, the entire ballot is not counted.

• If both reviewing judges determine a signature does not match the voter registration database, existing signature verification procedures in section 1-7.5-107.3(2) are followed.

• If both reviewing judges determine the elector is eligible or the signature is valid, the mail or mail-in ballot is counted in full.
