SB 14-097 Summary

• Adds insurance companies and their employees, contractors, and agents to the list of entities protected from liability when engaging in wildfire mitigation and property protection activities intended to safeguard policyholders' property from harm or destruction.

• Explicitly excludes insurers and insurance company personnel from being considered "private organizations" or "volunteers" entitled to immunity under the Colorado Governmental Immunity Act, regardless of whether their activities are directed by emergency planning committees or fire/law enforcement agencies.

• Authorizes insurers to provide emergency services protecting policyholders' property during emergency events, notwithstanding other provisions of law.

• Maintains exception to immunity for willful and wanton acts or omissions by public agencies and private organizations engaged in hazardous material response and emergency planning activities.

• Effective date: July 1, 2014.
