SB14-113 Summary

• Prohibits employers from requiring employees to join or remain members of labor organizations or pay dues, fees, and assessments to unions as a condition of employment, effective July 1, 2014.

• Voids any written or oral agreements between employers and labor organizations that violate employee rights under the new provisions.

• Creates criminal penalties for violations including fines up to $1,000 and/or up to 90 days in county jail, with civil remedies allowing injured employees to recover damages and attorney fees.

• Authorizes the attorney general and district attorneys to investigate alleged violations and prosecute violators.

• Eliminates exceptions for all-union agreements except those approved by majority vote of affected employees, and repeals the prior exception for the building and construction industry.
