SB14-134 Summary

• Repeals the water quality control fund and replaces it with six new specialized funds: public and private utilities, construction, commerce and industry, pesticides, water quality certifications, and animal feeding operations funds, effective July 1, 2014.

• Transfers the unobligated balance of the old water quality control fund to the new funds on a percentage basis: 53% to public and private utilities, 17% to construction, and 30% to commerce and industry.

• Grants the water quality control commission rule-making authority to set permit fees and application review fees for each fund category based on the division's direct and indirect costs, replacing previous statutory fee schedules.

• Repeals the statutory drinking water fee schedule and authorizes the water quality control commission to establish annual fees for public water system categories by rule to cover Safe Drinking Water Act administration costs.

• Establishes procedural requirements for permit applications, including 180-day decision deadlines, public notice and comment periods, and temporary permit issuance if final permits are not issued within statutory timeframes.
