SB 14-190 Summary

• Creates a statewide criminal discovery sharing system to be developed and maintained by the Colorado District Attorneys' Council, integrated with their ACTION system, and operational by November 1, 2016.

• Establishes a Discovery Project Steering Committee with representatives from the attorney general, state court administrator, public defender, criminal defense bar, district attorneys, sheriff, police chief, and district court judge to oversee vendor selection and system development.

• Implements a criminal discovery surcharge of $10 per felony conviction and $5 per misdemeanor conviction for defendants represented by private counsel or appearing pro se, with courts able to waive surcharges for indigent defendants.

• Allocates 5 percent of surcharge collections to the Judicial Stabilization Cash Fund and 95 percent to a new Statewide Discovery Sharing System Surcharge Fund for system development and maintenance.

• Appropriates $5,300,000 from the general fund for fiscal years 2014-2015 to implement the system and provides civil immunity to district attorneys making good-faith redaction efforts on discovery documents.
