CO HB1010

Establishes a legal presumption that beneficiaries have received information or account statements when a trustee has procedures in place requiring mailing or delivery to beneficiaries under Colorado Revised Statutes 15-16-303(6).

Permits trustees to deliver information and account statements to beneficiaries electronically or provide electronic access, provided the beneficiary has agreed to receive electronic delivery or access.

Applies the presumption of receipt to final accounts or statements required by section 15-16-307 when delivery meets the other requirements of that section.

Takes effect on August 5, 2015, or ninety days after final adjournment of the general assembly, whichever is later, unless a referendum petition is filed, in which case approval by voters in November 2016 is required.

Applies to conduct occurring on or after the effective date of the act.
