HB 15-1011 Summary

• Narrows the prohibition on disclosing voter information to apply only to election officials, watchers, and other persons who obtain knowledge of how someone voted while performing elections-related duties or functions.

• Removes the general ban preventing any person from revealing how or for whom a voter has voted, limiting misdemeanor penalties to those in official election capacities.

• Repeals provisions in both the Uniform Election Code of 1992 and Municipal Election Code that prohibit voters from showing their ballots to others in a way that reveals the contents.

• Takes effect 12:01 a.m. on August 5, 2015, unless a referendum petition is filed, in which case approval by voters at the November 2016 general election is required.

• Applies to elections conducted on or after the effective date of the act.
