HB15-1068 Summary

• Creates a rebuttable presumption that a driver is impeding traffic if at least 4 motor vehicles are following immediately behind and the driver is traveling at least 5 miles per hour below the posted speed limit.

• Exempts vehicles designed to or normally driven at less than 25 miles per hour that display a triangular slow-moving vehicle emblem on the rear from the traffic impeding prohibition.

• Allows drivers to avoid violating the impeding traffic law by driving in the right-hand lane until impeded traffic passes or pulling off the roadway at the first safe location until impeded traffic passes.

• Takes effect 90 days after final adjournment of the 2015 legislative session (August 5, 2015), unless subject to a referendum petition requiring approval by voters in November 2016.

• Applies to offenses committed on or after the effective date of the act.
