HB15-1081: Physical Privacy Act

• Permits persons to restrict access to sex-segregated locker rooms based on an individual's actual, biological sex without violating Colorado's public accommodation discrimination laws.

• Amends Colorado Revised Statutes 24-34-601 to add a new exemption allowing sex-based restrictions in sex-segregated locker rooms as a non-discriminatory practice.

• Legislative findings assert that children and young adults have natural privacy concerns about being viewed unclothed by members of the opposite biological sex in locker rooms.

• Establishes that parents have a reasonable expectation that sex-segregated locker rooms will not allow their minor children to be viewed by or view members of the opposite biological sex in various states of undress.

• Declares the act necessary for immediate preservation of public peace, health, and safety under the safety clause provision.
