HB 15-1082: Time Limit On Mental Health Disciplinary Actions

• Establishes a 5-year statute of limitations for commencing disciplinary proceedings against mental health professionals, measured from the alleged act or failure to act giving rise to the proceeding.

• Amends Colorado Revised Statutes section 12-43-224 to add the time limitation to existing disciplinary proceedings provisions.

• Applies only to proceedings commenced on or after the effective date of July 1, 2015.

• Includes a safety clause declaring the act necessary for immediate preservation of public peace, health, and safety.
