House Bill 15-1094 Summary

• Expands the Restorative Justice Coordinating Council membership to include the state public defender, a judge appointed by the Colorado Supreme Court Chief Justice, and a law enforcement representative appointed by the state court administrator.

• Modifies the restorative justice satisfaction evaluation to include preconference questionnaires for offenders and participating victims, if practicable, in addition to postconference assessments.

• Authorizes the Restorative Justice Coordinating Council to accept and deposit moneys from trainings, conferences, gifts, grants, and donations into the restorative justice surcharge fund for supporting restorative justice practices.

• Allows district attorneys to waive the first-time offender qualification for juveniles in the restorative justice pilot project and expands eligible offenses to include petty offenses and municipal offenses when law enforcement directly diverts juveniles to the program.

• Takes effect August 5, 2015, or if a referendum petition is filed, pending voter approval at the November 2016 general election.
