Creates new statute 29-20-204.5 establishing that local governments adopting or enforcing ordinances, resolutions, or policies prohibiting hydraulic fracturing are liable to royalty owners for lost royalty values

Applies liability to prohibitions on hydraulic fracturing treatments conducted on oil and gas wells located or that would be located within the local government's jurisdiction

Takes effect August 5, 2015, unless a referendum petition is filed, in which case effectiveness is contingent upon voter approval at the November 2016 general election

Applies only to adoption or enforcement of hydraulic fracturing prohibitions occurring on or after the act's effective date
