New diesel vehicles with a gross vehicle weight rating of 26,000 pounds or more and model year 2014 or newer are exempt from emissions testing until reaching their sixth model year, instead of the fourth model year for other heavy-duty diesel vehicles.

The exemption period ends upon the earliest of: the sixth model year anniversary, or ownership transfer (if within 12 months of expiration), except for lessor-to-lessee transfers.

For vehicles enrolled in the heavy-duty diesel fleet inspection and maintenance program, those meeting the 26,000-pound weight rating and 2014 or newer model year criteria receive a sixth model year exemption instead of the standard fourth model year exemption.

No additional state appropriations are required to implement the act.

The act takes effect August 5, 2015, unless a referendum petition is filed, in which case approval by voters at the November 2016 general election is required.
