HB15-1162: Prenatal Sex Nondiscrimination Act

• Prohibits knowingly performing an abortion when the abortion is sought based on the sex of the unborn child.

• Criminalizes using force or threats to coerce a sex-selection abortion, soliciting or accepting funds for sex-selection abortions, and transporting a woman into Colorado to obtain a sex-selection abortion.

• Violations are Class 2 felonies with sentencing between the minimum and twice the maximum of the presumptive range for a Class 2 felony.

• Defines "sex-selection abortion" as an abortion undertaken solely for purposes of eliminating an unborn child of an undesired sex, with exceptions for abortions intended to save the mother's life, preserve her health, remove a dead unborn child, or remove an ectopic pregnancy.

• Includes findings that sex-selection abortion constitutes sex discrimination and gender-based violence, noting that 86 percent of Americans support prohibiting the practice according to a 2006 Zogby poll.
