HB15-1203 Summary

• Creates an exception to Colorado's parole prohibition for inmates sentenced as habitual offenders under a pre-July 1, 1993 statute for crimes committed on or after July 1, 1985

• Allows these inmates to become parole-eligible after serving 40 calendar years minus any earned time credits authorized under Section 17-22.5-405

• Applies only to inmates sentenced pursuant to Section 16-13-101(2) as it existed prior to July 1, 1993, regardless of whether their crime occurred before or after July 1, 1990

• Takes effect August 5, 2015, unless a referendum petition is filed, in which case it requires voter approval at the November 2016 general election
