Reorganizes the highway maintenance division leadership by creating a new "Director of the Highway Maintenance Division" position to replace the "Chief Engineer" title for that division's head.

Transfers powers and functions of the highway operations and maintenance division to the Department of Transportation through a Type 2 transfer, with the Executive Director appointing the division director and other staff.

Updates hearing procedures to allow the Executive Director or designee (including the chief engineer or administrative law judge) to preside over departmental hearings, except for rule-making hearings which the Chief Engineer or designee may preside over.

Changes multiple statutory references throughout Colorado Revised Statutes from "highway operations and maintenance division" and "chief engineer" to "Director of the Highway Maintenance Division" while maintaining existing powers and duties.

Declares the act necessary for immediate preservation of public peace, health, and safety.
