HB15-1210 Summary

• Requires the Air Quality Control Commission, Water Quality Control Commission, and Solid and Hazardous Waste Commission to submit annual reports by January 15 to the Legislative Council listing all new and amended rules required by federal EPA regulations under the Clean Air Act, Clean Water Act, and Resource Conservation and Recovery Act.

• Prohibits the Division of Administration from submitting any rules to the EPA for approval unless the General Assembly first acts by bill to approve submission of that specific rule.

• Rules listed in the report cannot take effect for federal enforceability or state-level enforcement against any person unless the General Assembly approves them by bill.

• Bills approving submission of one or more rules from the report are exempt from the 5-bill limit imposed on General Assembly members.

• Repeals the existing air quality state implementation plan review process in Section 25-7-133(1) and (2) and takes effect 90 days after final adjournment of the 2015 legislative session, subject to referendum petition.
