HB 15-1267 Summary

• Permits individuals on probation to use medical marijuana as authorized under Colorado Constitution Article XVIII, Section 14, without violating probation terms.

• Exempts medical marijuana possession and use from being considered "another offense" that would violate probation conditions, except for defendants convicted of crimes under Article 43.3 of Title 12, C.R.S.

• Allows courts to prohibit medical marijuana use only if the defendant was convicted of a drug-related crime under Article 43.3 or if the court determines based on a substance abuse assessment that prohibition is necessary to accomplish sentencing goals.

• Applies to all persons on probation on or after the effective date of the act.

• Declared necessary for the immediate preservation of public peace, health, and safety.
