Adds new crime of assault in the second degree (paragraph c.5) for intentionally causing serious bodily injury to any person with intent to prevent a peace officer, firefighter, or emergency medical service provider from performing lawful duties.

Removes mandatory Department of Corrections sentencing requirement for defendants convicted under paragraph (c) of assault in the second degree, allowing courts discretion in sentencing while still requiring compliance with section 18-1.3-406.

Requires mandatory Department of Corrections sentencing for convictions under paragraph (c.5) when the victim is a peace officer, firefighter, or emergency medical service provider engaged in performance of duties.

Takes effect September 1, 2015, unless subject to referendum petition, in which case effectiveness depends on voter approval at November 2016 general election.

Applies only to offenses committed on or after the effective date of the act.
