Legislative Council staff must include the social cost of carbon in fiscal notes for "electricity generation measures" (bills or concurrent resolutions expected to significantly increase or decrease electricity generation from renewable or nonrenewable sources by qualifying retail utilities).

The social cost of carbon consists of an estimate of the increase or decrease in carbon emissions resulting from the measure and a monetary valuation of that change, which may be expressed as a range.

Legislative Council staff has 30 days from a measure's introduction to complete the fiscal note, during which all legislative deadlines are tolled until the note is made public.

If a reengrossed version of an electricity generation measure contains significant changes to the social cost of carbon, staff must update the estimate if possible.

The requirement does not apply to electricity generation measures introduced after the 88th day of a regular legislative session or during special sessions, though staff may prepare an analysis if possible; applies to bills introduced on or after January 1, 2017.
