HB 15-1351 Summary

• Establishes a 7-year statute of limitations for filing complaints related to mental health professional violations involving maintenance of records for clients 18 years of age or older, measured from when the person discovered or reasonably should have discovered the misconduct.

• The 7-year limitation applies only to record maintenance violations and does not restrict filing complaints for any other violations of mental health professional regulations.

• Amends Colorado Revised Statutes Section 12-43-224 to add the filing deadline requirement for complaints submitted to the Division of Professions and Occupations.

• Takes effect July 1, 2015, and applies to complaints or notices filed with the division on or after that date.

• Includes a safety clause declaring the act necessary for immediate preservation of public peace, health, and safety.
