Creates the Health Care Affordability Enterprise as a government-owned business within the Department of Health Care Policy and Financing to charge and collect a new hospital provider fee beginning July 1, 2016, replacing the existing fee previously collected by the state department.

Designates the enterprise as exempt from TABOR (Taxpayer's Bill of Rights) spending limits and caps so long as it retains authority to issue revenue bonds and receives less than 10% of revenues in government grants.

Transfers the hospital provider fee oversight and advisory board to the enterprise on July 1, 2016 through a Type 3 transfer; current board members continue serving on the enterprise board with the same appointment process.

Enterprise must leverage new fee revenue to obtain federal matching funds and expend revenues to increase hospital reimbursement rates, expand medical assistance eligibility, and pay administrative costs.

Bill does not take effect if federal Centers for Medicare and Medicaid Services determine it does not comply with federal law; the executive director must notify the revisor of statutes by June 1, 2016 if such determination is made.
