SB15-014 Summary

• Establishes guidelines for physicians making medical marijuana recommendations in consultation with the Department of Public Health and Environment and medical marijuana specialists.

• Creates registration requirements for primary caregivers (cultivating, transporting, and advising types) with a 36-plant limit per caregiver unless patients have extended plant counts based on medical necessity, with a maximum of 99 plants.

• Allows homebound patients to register for voluntary cultivation operations cultivating more than six plants, with a 99-plant maximum for individual patients; prohibits patients from cultivating more than 99 plants unless licensed as a medical marijuana business.

• Permits school districts to adopt policies allowing parents or medical professionals to possess and administer medical marijuana to students on school grounds if the student holds a valid recommendation and appropriate safeguards are in place.

• Provides funding totaling $1.3 million for fiscal year 2015-16 to support medical marijuana program administration, law enforcement collection of program information, and legal services related to marijuana enforcement.
