SB15-038 Summary

• County departments of human or social services must provide auditors conducting financial or performance audits access to all records, including personal identifying information necessary to achieve audit objectives.

• Authorization applies to auditors retained by a county or authorized under county charter or ordinance.

• Auditors and their staff are prohibited from releasing, disclosing, or publicly reporting any confidential information obtained during the audit, including personal identifying information.

• Persons who unlawfully release confidential information obtained during an audit are subject to applicable criminal or civil penalties.

• Effective date is August 5, 2015, unless a referendum petition is filed, in which case the measure requires voter approval at the November 2016 general election.
