Department of Public Health and Environment must obtain Colorado Public Utilities Commission approval through an evidentiary hearing before submitting any carbon dioxide emissions reduction plan to the EPA under federal Clean Air Act Section 111(d)

Proposed state plan must limit average annual retail rate increases to 2% or less for electric utility customers

Commission approval must be accompanied by a joint report from the Commission and Department assessing effects on rates, reliability, and Colorado's economy

General Assembly must approve the state plan by two-thirds affirmative vote in both chambers before submission to EPA

Each utility with a covered electric generating unit must conduct annual electric system reliability reviews and submit results to the Commission
