Senate Bill 15-109 Summary

• Creates the At-Risk Adults with Intellectual and Developmental Disabilities Mandatory Reporting Implementation Task Force in the Department of Human Services to study and recommend policies for mandatory reporting of mistreatment, abuse, neglect, or exploitation of eligible adults.

• Task force must prepare recommendations on protective services, statutory and regulatory conforming changes, cost estimates for implementation, sustainable funding sources, employee training standards, and mandatory reporter training by December 1, 2015.

• Requires mandatory reporters identified in statute to report known or suspected abuse, exploitation, neglect, or mistreatment of at-risk adults with intellectual and developmental disabilities to law enforcement within 24 hours, effective July 1, 2016.

• Expands the definition of mandatory reporters to include financial institution personnel, with reporting requirements limited to direct observations or actual knowledge of abuse or exploitation involving at-risk adults with intellectual and developmental disabilities.

• Task force is repealed effective July 1, 2016; mandatory reporting requirements for adults with intellectual and developmental disabilities become effective July 1, 2016.
