SB 15-110 Summary

• Extends the sunset date for regulation of cremation and mortuary science from July 1, 2015 to September 1, 2024, implementing recommendations from the 2014 Department of Regulatory Agencies sunset report.

• Requires funeral establishments and crematoriums to obtain positive identification attestation from next of kin, county coroner, or authorized care facility personnel before taking custody of human remains.

• Establishes funeral establishments' responsibility to identify and track human remains from custody until final disposition, release per instructions, or transfer to another authorized entity.

• Creates new requirements for crematories to establish custody procedures and minimum standards for positive identification and chain of custody of human remains, allowing facilities to use own procedures if they meet or exceed director-established standards.

• Appropriates $4,726 to the Department of Regulatory Agencies and $4,726 to the Department of Law for 2015-16 fiscal year to implement legal services related to the bill; effective July 1, 2015.
