CO SB208

Grants the State Controller authority to allow expenditures for capital construction budget items based on nonmonetary adjustments (name changes, time extensions, scope changes, department transfers) when unforeseen circumstances arise and the legislature is not in session, effective for fiscal years commencing July 1, 2015 or later.

Requires nonmonetary adjustment requests from most state departments to be approved sequentially by the Office of State Planning and Budgeting, Capital Development Committee, and Joint Budget Committee by majority vote before the Controller may authorize the expenditure.

Exempts requests from the Department of Law, Department of Treasury, Department of State, Judicial Department, and Legislative Department from Office of State Planning and Budgeting approval, requiring only Capital Development Committee and Joint Budget Committee approval.

Mandates that nonmonetary adjustments must be consistent with the original appropriation purpose, may not change the appropriation amount, and requires the Joint Budget Committee to introduce a supplemental appropriation reflecting the adjustment.

Adds a Capital Development Committee-approved waiver allowing certain capital construction projects to be exempted from the Arts in Public Places requirement if the committee determines by affirmative vote that the project does not meet the requirement's original purpose.
