HB 16-1008 Summary

• The Department of Transportation may designate unlaned roadway areas (such as shoulders) for exclusive use by commercial vehicles designed to transport 16 or more passengers that are operated by governmental entities, government-owned businesses, or their contractors.

• Authorized vehicles must operate under written conditions of use established by the Department in consultation with the Colorado State Patrol before authorization is granted.

• Drivers of authorized vehicles have sole discretion to use the designated areas based on their safety assessment and are not required to follow signage indicating conditions of use.

• Authorized users operating in accordance with the written agreement conditions do not violate section 42-4-1007 or 42-4-1004 of Colorado law.

• The Department of Transportation shall coordinate with local governmental agencies in implementing the program.
