HB16-1020: Operation of Unmanned Aircraft Systems

• Creates felony offense of "introducing contraband in the first degree" for operating unmanned aircraft systems within 5 miles of detention facilities with intent to smuggle dangerous instruments, alcohol, controlled substances, or marijuana into the facility.

• Prohibits operation of unmanned aircraft systems within 5 miles of airports without authorization from air traffic control, above 400 feet altitude, or in airspace directly above detention facilities.

• Prohibits unmanned aircraft operations that interfere with manned aircraft, violate federal aviation laws, or breach temporary flight restrictions (TFRs) or notices to airmen (NOTAMs) issued by FAA.

• Violations of aircraft operation restrictions constitute class 1 misdemeanor; exempts public unmanned aircraft systems operated by government agencies under FAA authorization.

• Effective August 10, 2016, subject to referendum petition approval.
