HB 16-1030 Summary

• Removes the prohibition on off-highway vehicles crossing state highways within municipal jurisdiction, allowing direct at-grade crossings in municipalities.

• Permits counties, cities and counties, cities, and towns to require off-highway vehicle drivers to have a valid driver's license or carry liability insurance on streets, roads, and highways within their jurisdiction.

• Exempts off-highway vehicle operators from driver's license and liability insurance requirements in certain circumstances specified in statute sections 33-14.5-108(1)(a) to (1)(e) and (1)(g) to (1)(i).

• Requires cities and towns seeking to regulate state highway crossings under Colorado Department of Transportation jurisdiction to obtain written approval from the regional office, with requests deemed approved if not addressed within 60 days.

• Designates the act as necessary for immediate preservation of public peace, health, and safety.
