CO HB1038

Allows counties that do not cover law enforcement and fire protection employees under Social Security to elect coverage under the statewide defined benefit plan and statewide death and disability plan administered by the Fire and Police Pension Association by filing a resolution of affiliation with the board.

Requires employees' duties to be directly involved with the provision of law enforcement or fire protection, as certified by the county, to be eligible for coverage.

Makes the election of coverage under the plan irrevocable once a county affiliates.

Takes effect on August 10, 2016, unless a referendum petition is filed, in which case it requires voter approval at the November 2016 general election to take effect.
