HB 16-1062 Summary

• Imposes a 7-year statute of limitations for complaints filed against mental health professionals alleging violations related to maintenance of records for clients 18 years of age or older

• The 7-year period begins when the complainant discovered or reasonably should have discovered the misconduct

• The limitation applies only to record maintenance violations and does not restrict the filing of complaints for any other violations of the mental health professional licensure article

• Takes effect July 1, 2016, and applies to complaints filed with the Division of Professions and Occupations on or after that date
