Health benefit plans covering prescription eye drops must provide coverage for early refills if requested by the insured at least 21 days before a 30-day supply runs out, 42 days before a 60-day supply runs out, or 63 days before a 90-day supply runs out.

Early refills are only allowed if the original prescription states additional quantities are needed and the refill request does not exceed the stated additional quantities.

Health benefit plans must cover one additional bottle of prescription eye drops every three months if requested at the time the original prescription is filled and intended for use at a day care center, school, or adult day program.

Prescription eye drop benefits are subject to the same annual deductibles, copayments, and coinsurance as other prescription drug benefits under the health plan.

The act becomes effective January 1, 2017, unless a referendum petition is filed, in which case it requires voter approval at the November 2016 general election.
