HB 16-1098 Summary

• Modifies information sharing provisions in juvenile delinquency cases to clarify that access to or exchange of information not addressed by statute shall be governed by other applicable law.

• Requires district attorneys to report annually to the division of criminal justice the names and demographic information (date of birth, race, ethnicity, gender) of students granted pre-file juvenile or adult diversion for offenses occurring at schools, school vehicles, or school events, beginning August 1, 2015.

• Requires law enforcement agencies to report annually to the division of criminal justice information on all student tickets, summons, and arrests occurring at schools or school events, beginning August 1, 2016.

• Restricts use of all reported student information to research purposes related to school discipline and requires that data be released only in aggregate form without identifying individual students.

• Provides immunity from criminal or civil penalties for district attorneys and law enforcement agencies complying with the reporting requirements.
