HB 16-1107: DORA Administrative Complaint Time Frames

• Establishes a 7-year time limit for professions and occupations licensing authorities in the Department of Regulatory Agencies to file administrative complaints against regulated persons, with the period running from the alleged action or failure to act.

• For claims involving persons under 18 years old, the 7-year period begins after the person's eighteenth birthday rather than from the alleged action.

• Requires licensing authorities to render a final decision in disciplinary proceedings within 2 years after making a motion, commencing an investigation, or filing a complaint.

• Defines "professions and occupations licensing authority" as any agency in the Department of Regulatory Agencies.

• Takes effect August 10, 2016, and applies to disciplinary proceedings commenced on or after the effective date, subject to possible voter approval if a referendum petition is filed.
